By accessing or using FITABOLISM's website, applications, or services (collectively, the "Services"), you agree to be bound by these Terms & Conditions and all applicable laws and regulations. If you do not agree with any part of these terms, you must discontinue use of the Services immediately.

These Terms constitute a legally binding agreement between you and FITABOLISM Health Technologies Pvt. Ltd. ('Company', 'we', 'our', or 'us'), a company registered under the laws of India.

FITABOLISM provides health and wellness coaching, nutrition guidance, fitness programs, and related digital tools including but not limited to BMI, TDEE, and Macro calculators. Our services are delivered through a combination of human experts (coaches) and digital platforms.

The Services are intended for general wellness purposes only. They do not constitute medical advice, diagnosis, or treatment. Always consult a qualified healthcare professional before making significant changes to your diet, exercise, or health routine.

We reserve the right to modify, suspend, or discontinue any part of the Services at any time, with or without notice. We shall not be liable to you or any third party for any such modification, suspension, or discontinuation.

You must be at least 18 years of age to use the Services. By agreeing to these Terms, you represent and warrant that you are 18 or older. If you are under 18, you may only use the Services with the involvement and consent of a parent or legal guardian.

You are responsible for ensuring that your use of the Services complies with all applicable laws in your jurisdiction.

You are responsible for maintaining the confidentiality of your account credentials. You agree to notify us immediately of any unauthorised use of your account. We will not be liable for any loss or damage arising from your failure to comply with this obligation.

You agree not to use the Services for any unlawful purpose, to impersonate any person or entity, to upload or transmit any harmful or offensive content, or to interfere with or disrupt the integrity or performance of the Services.

We reserve the right to terminate or suspend accounts that violate these Terms, without prior notice.

All fees for FITABOLISM programs and services are stated at the time of purchase and are subject to applicable taxes. Payment must be made in full prior to accessing paid services.

Refunds are available within 7 days of purchase, provided no more than one coaching session has been consumed. After this period, or once sessions have begun, no refunds will be issued. Exceptions may be made in extraordinary circumstances at our sole discretion.

If you wish to cancel a subscription or recurring plan, you must do so at least 48 hours before the next billing date. Cancellation requests made after this window will take effect from the next billing cycle.

The content, programs, and tools provided by FITABOLISM are for informational and general wellness purposes only. They are not a substitute for professional medical advice, diagnosis, or treatment. Never disregard professional medical advice or delay seeking it because of something you have read or accessed through our Services.

Before beginning any fitness or nutrition program, consult your physician or another qualified health provider, especially if you have a pre-existing medical condition. Results vary from person to person and are not guaranteed.

FITABOLISM shall not be held liable for any injury, loss, or damage arising from the use of, or reliance on, the information or programs provided through our Services.

All content on the FITABOLISM platform — including text, graphics, logos, images, videos, and software — is the exclusive property of FITABOLISM Health Technologies Pvt. Ltd. or its content licensors, and is protected by applicable intellectual property laws.

You may not reproduce, distribute, modify, create derivative works of, publicly display, or otherwise exploit any content from the Services without our express written consent.

Your use of the Services is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Services, you consent to our collection and use of your personal data as described in the Privacy Policy.

To the fullest extent permitted by applicable law, FITABOLISM shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, goodwill, or other intangible losses, resulting from your access to or use of (or inability to access or use) the Services.

Our total liability to you for any claims arising from or related to these Terms or the Services shall not exceed the amount you paid us in the 90 days preceding the claim.

These Terms are governed by and construed in accordance with the laws of India. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in Pune, Maharashtra, India.

We encourage you to first reach out to us at support@fitabolism.com to resolve any disputes informally before initiating formal legal proceedings.

We reserve the right to update these Terms at any time. Changes will be posted on this page with an updated 'Last Updated' date. Continued use of the Services after any changes constitutes your acceptance of the new Terms.

We recommend reviewing these Terms periodically. For material changes, we will make reasonable efforts to notify you via email or a notice on the platform.
